Still operating
Explore an additional use for records you already keep.
Start with one or two systems and an available date range. Identify who can approve a data agreement and who understands those systems. Keep the initial discussion to a description of the records.
Selling the business
Work out how a data agreement fits the business sale.
Ask your transaction advisers who controls the records and whether an additional agreement affects the sale, diligence or promises to the buyer. The timing depends on your transaction documents.
Winding down
Check the opportunity while the records are still accessible.
Inventory retained systems and responsible people before access changes. Confirm retention obligations, authority and costs with your advisers before making any disposal or licensing decision.
Already closed
Find out what remains and who can authorize its use.
Establish which entity or person controls the records, whether systems can still be accessed and how large the team was when the records were created. A closed business is not automatically excluded.
Your agreements and circumstances determine the right steps. These are preparation prompts, not legal instructions.
